Set out below are the terms and conditions for using our website and that will govern our relationship when you sell items to us. If you decide to proceed, these become the terms of the contract between us.
The words “we” and “us” refer to Cellcycle.ca and “website” refers to www.cellcycle.ca, the singular includes the plural.
We need you to give us your name, address, celldevice number and email address so that we can remit payment to you. We do not retain this information for any purpose other than making payment to you.
You must warrant that you are: the owner of the device(s) that you wish to sell to us, that you have title to it and ability to sell it free from any claims of any other party; that you are 18 or over or have your parents or legal guardian’s consent and that by us acting on your behalf we will not thereby become party to any criminal activity.
Provided you properly use the Canada Post mailing label system linked to this website, you pack your items securely to prevent damage in transit, and your shipment is initially scanned by Canada Post, your items will be insured against loss for up to $100. If you wish to insure your shipment for more than $100, you may do so at your own expense. The tracking applications of Canada Post will be the sole proof that your items were shipped to us. In the event that your shipment is lost or stolen prior to reaching us you must make a claim against the carrier. We may reject delivery of any package that appears to be damaged, opened, or tampered with. We have no liability to you for any attempted delivery or return of any such items.
No liability to you will arise from use of our website, shipping and anything we do or might fail to do.
The price that we quote you for your device will be honored provided that: we receive device(s) for appraisal at our processing facility within in the same calendar month as the date you receive a quotation from us via our website; the devices shipped are in working condition and are the age, make and model you received a quotation for; they power-up and perform as intended by the original equipment manufacturer following after having been partially recharged at our processing facility; are not broken, crushed, water damaged or have broken displays and housing/cases are complete and intact.
If the above criteria are not met upon appraisal, we may alter the quoted price, which may include rejecting or reducing the price of the device. Regardless of the actual appraised price or rejection we cannot return any devices to you. By sending your devices to us, you agree to accept our appraisal of them and either our payment amount to you or if we reject your devices then for us to recycle them responsibly on your behalf.
Each mobile device must have a valid Electronic Serial Number (ESN) or International Mobile Equipment Identity (IMEI) and not be identified on any database as lost or stolen and must not be restricted from being reactivated for reuse. Devices with outstanding balances associated with the ESN number, or listed as lost or stolen cannot be accepted for sale but will be recycled responsibly.
Functioning AC adapters included with quoted devices have a value of $1 each when included with functioning devices.
Our standard practice is to remove all data and/or stored files from your device; however, we cannot guarantee that we will be able to do so. Before shipping your devices, please remove all data from them. By sending the device to us you agree to release us from any claim that may arise in respect of the device or data contained on it.
You must deactivate the device prior to shipping and ensure that you have paid all charges to your carrier.
We will mail a cheque to you within 30 days of receipt of your device at our processing facility provided it is not rejected. Please allow time for delivery of your cheque by Canada Post beyond 30 days.
The contract between us will be governed by the laws of Ontario.
You agree to indemnify and hold us harmless against any and all liability, claims, suits, losses, costs and legal fees (paid in advance) caused by, arising out of or resulting from any breach or claimed breach by you of these terms and conditions, including claims brought by third parties. You further warrant that you will fully defend, protect, indemnify, and hold us and our lawful successors and assigns harmless from any adverse claim thereto.
We assert copyright in respect of the content of this website.
In conclusion, we are delighted to receive your business now and in the future, in accordance (only) with the above terms and conditions.
